Agreement
These Terms of Service ("Terms") govern your access to and use of the Duane's List website, applications, and related services (collectively, the "Service") operated by Duane's List ("we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
The Service
Duane's List is a community platform that helps neighbors organize, share, and discover professional recommendations through personal lists, circles of trusted curators, and professional profiles. The Service may include both free and paid features in the future; core neighbor features are intended to remain free as described on our website.
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian.
By using the Service, you represent that you have the legal capacity to enter into these Terms and that all information you provide is accurate and current.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
We use email-based verification to sign you in. You agree to provide a valid email address and to keep it up to date. One person or legal entity may not maintain more than one account for abusive or deceptive purposes.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
Your content
You retain ownership of the lists, notes, rankings, and other content you create on the Service ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content solely as necessary to operate and improve the Service — including showing public lists and aggregated signals you choose to make visible.
You represent that you have the right to post your User Content and that it does not violate any third party's rights or applicable law. You are solely responsible for the accuracy of professionals you add, notes you write, and recommendations you share.
Private notes and non-public lists remain under your control. Making a list public means other users may view, save, and reference that list in accordance with Service features.
Professional profiles
Professionals may claim or manage profiles associated with their business. By claiming a profile, you represent that you are authorized to act on behalf of that business and that information you provide is truthful.
Listing on Duane's List does not constitute our endorsement of any professional. Rankings, "would call again" rates, and list counts reflect community activity — not our independent verification of quality, licensing, insurance, or fitness for a particular job.
We do not offer pay-to-rank placement. Professionals cannot purchase higher positions in neighbor lists or trust signals.
Acceptable use
You agree not to misuse the Service. Prohibited conduct includes, without limitation:
- Posting false, misleading, or defamatory reviews or recommendations
- Harassing, threatening, or impersonating other users or professionals
- Scraping, crawling, or automated access except as we expressly permit
- Attempting to gain unauthorized access to accounts, systems, or data
- Uploading malware, spam, or content that violates intellectual property or privacy rights
- Manipulating rankings, list counts, or "would call again" signals through fake accounts or coordinated inauthentic behavior
- Using the Service for any unlawful purpose
We may remove content or restrict access that we reasonably believe violates these rules.
Third parties
The Service helps you discover professionals recommended by neighbors. Any hiring, contracting, or payment arrangement you enter into with a professional is solely between you and that professional. We are not a party to those transactions and are not responsible for the quality, safety, legality, or outcome of any services performed.
Links or contact details for third-party businesses are provided for convenience. We do not control and are not responsible for third-party websites or services.
Intellectual property
The Service, including its design, logos, software, and documentation (excluding User Content), is owned by Duane's List and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without prior written consent.
Feedback you provide may be used by us without obligation or compensation to you.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that recommendations, list data, or professional information will be accurate, complete, or suitable for your needs. You use the Service at your own risk.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUANE'S LIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Duane's List and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your dealings with any professional or other user.
Termination
You may stop using the Service at any time. You may request account deletion by contacting us at [email protected].
We may suspend or terminate your access immediately if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice within the Service at least 14 days before the changes take effect. The "Last updated" date at the top of this page reflects the most recent revision.
Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
